T Visa

Immigration protection for victims of human trafficking.

If you are a victim of human trafficking, the T visa provides special protection, work authorization, and a path toward permanent residency.

What Is Human Trafficking?

Human trafficking is the exploitation of a person through:

  • Force, fraud, or coercion
  • Forced labor
  • Involuntary servitude
  • Commercial sexual exploitation
  • Dangerous work under threat

Who Qualifies for a T Visa?

You may apply for a T visa if:

  • You are a victim of human trafficking
  • You are in the United States, its territories, or at a port of entry as a result of the trafficking
  • You have suffered substantial abuse
  • You are willing to cooperate with law enforcement (unless you are under 18 years of age)

Benefits of the T Visa

  • Authorization to remain in the U.S. for up to 4 years
  • Work permit
  • Social Security number
  • Driver’s license
  • Access to federal services similar to those available to refugees
  • After 3 years, you may apply for permanent residency
  • May include immediate family members

Special Protections

  • Confidentiality — the trafficker is not notified
  • Access to trafficking victim services
  • Assistance for trauma and rehabilitation
  • Protection against retaliation

Processing Times

Typically 2 to 4 years, with priority given to urgent cases.

What You Should Know

Human trafficking is a serious crime. Victims are not responsible for their exploitation. There are organizations that can provide emotional support in addition to legal assistance.
