VAWA

Immigration protection for victims of domestic violence under the Violence Against Women Act.

The Violence Against Women Act (VAWA) provides an immigration pathway for individuals who have been abused by a spouse, stepparent, or parent who is a U.S. citizen or lawful permanent resident.

What Is VAWA?

VAWA allows victims of domestic violence to self-petition for permanent residency without depending on their abuser.

Who Qualifies for VAWA?

You may file under VAWA if:

  • You are a victim of domestic violence or a serious crime
  • Your abuser is or was your spouse, stepparent, or parent who is a U.S. citizen or lawful permanent resident
  • You lived with your abuser
  • You suffered physical, mental, or emotional abuse
  • You are a person of good moral character

Types of Abuse Covered

  • Physical abuse
  • Sexual abuse
  • Emotional or psychological abuse
  • Threats and coercion
  • Isolation from family and community
  • Economic control
  • Threats of deportation

Benefits of VAWA

  • Self-petition (no consent from the abuser is required)
  • Protection against deportation
  • Work authorization
  • Permanent residency
  • Confidentiality — the abuser is not notified
  • Protection for your family (may include children)

The VAWA Process

  • File Form I-360 (Self-Petition)

Provide evidence of:

  • Your relationship with the abuser

  • A valid marriage or family relationship

  • Cohabitation

  • The abuse you suffered

  • Undergo a medical examination

  • Attend an immigration interview

  • Upon approval, obtain permanent residency

Special Protections

Immigration officers are trained to recognize the dynamics of abuse. It is understood that victims may not have complete documentation or clear evidence.
